When parents don’t live together anymore, they are supposed to exercise parental authority jointly, except in exceptional cases. This implies that important decisions regarding the health, education, training, leisure, schooling and religious or philosophical orientation of the child are to be agreed upon by both parents. In case of a divorce, it will also have to be determined the financial contribution of each parent.
Amicable agreements can be endorsed by the Family Court. When the parents do not agree and the case is brought before the Family court, the parties will be informed by the magistrates of the possibility of resolving their dispute through Conciliation, mediation or any other amicable settlement of conflicts.
When the family court is called upon to issue a ruling, it will decide with due regard on the best interests of the child concerning the financial contribution etc.
